China to beef up punishment on drunk driving

China's top legislature has further beefed up punishment on dangerous driving behaviors like drink driving and street racing, responding to public's great concerns on road traffic safety, Xinhuanews.net reported on Tuesday.

The latest draft amendment of criminal law stipulates that drunk drivers will be convicted guilty of "dangerous driving" in any case along with one to six months' detention and penalties.

Currently, drunk drivers are detained for 15 days, according to the Law on Road Traffic Safety

It also regulates the driver who also commits other crimes shall be convicted of the crime which has the more severe punishment.

The survey from a related road traffic department reported 313,000 cases of drunk driving in 2009. Though the death roll of this kind of traffic accident is decreasing, drunk driving and street racing are the two main "road assassins" heavily criticized by the public.

Prof. Zhao Bingzhi, head of the Law School at Beijing Normal University said including drunk driving and street racing crimes into criminal law would warn against such dangerous behaviors and further prevent traffic accidents.

However, the amendment has not clarified whether the dangerous driving which causes severe accidents can be considered a crime "against public security by dangerous behaviors."
